NOTICE IS HEREBY GIVEN BY THE TOWN OF PATTERSON ZONING BOARD OF APPEALS of a public hearing to be held on Wednesday, January 15, 2025 at 7:00 p.m. at the Patterson Town Hall, 1142 Route 311, Patterson, Putnam County, New York to consider the following applications:
1. Joseph Plaskett, Jr.: Case #11-24 – Special Use Permit –Accessory Residential Building & Area Variances (Held Over since November 19, 2024): Applicant is requesting to obtain a special use permit and two area variances pursuant to §154-106 of the Patterson Town Code to legalize an existing accessory building with a three-car garage below. Patterson Town Code §154-106 requires applicants to obtain a special use permit in order to construct an accessory building for residential occupancy. Town Code §154-106(D) limits the garage space of accessory buildings to a maximum of 500 sq. ft. Existing garage is 972 sq. ft.; variance requested is for 472 sq. ft. Town Code §154-106(H) limits the height of accessory buildings to a maximum of 80% of the height of the principal dwelling. Existing principal dwelling is 26 ft.in height and existing garage is 21 ft. in height; variance requested is for.5 ft. in height over the 20.5 ft. permitted. This property is located at 938 Route 311. Tax Map 13.7-1-35 (R-1 Zoning District).
2. Fredy Beltran & Doris Vasquez: Case #20-24– Area Variances: Applicant is requesting three area variances pursuant to §154-7 and §154-27A(12)(a) of the Patterson Town Code in order to legalize a 4 ft. x 6 ft. shed for garbage receptacle storage forward of the principal dwelling. Town Code §154-7 requires accessory structures in the R-1 Zoning District to meet a minimum front yard setback of 35 ft. and a minimum side yard setback of 15 ft. Structure exists 10 ft. from the front property line and 13 ft. from the side property line; variances requested are for 25 ft. and 2 ft. respectively. Town Code §154-27A(12)(a) forbids accessory structures from being located in the front yard; variance requested is to allow the structure to be located in the front yard. This property is located at 155 Route 164. Tax Map 23.11-1-45 (R-1 Zoning District).
3. Michelle Vitner (Margaret McAuliffe): Case #21-24 – Special Use Permit –Accessory Residential Building & Area Variances: Applicant is requesting to obtain a special use permit and two area variances pursuant to §154-106 and §154-7 of the Patterson Town Code to legalize an existing accessory dwelling which previously functioned as a detached garage. Patterson Town Code §154-106 requires applicants to obtain a special use permit in order to construct an accessory building for residential occupancy. Town Code §154-106(C) requires the property to be at least 5 acres in size. The existing lot is 0.94 acres; variance requested is for 4.1 acres of lot size. Town Code §154-7 requires accessory structures in the R-4 Zoning District to meet a minimum side yard setback of 20 ft. Accessory dwelling exists 14.5 ft. ± from the side property line; variance requested is for 6 ft. This property is located at 324 Fair Street. Tax Map 44.-3-4 (R-4 Zoning District).
4. Michelle Vitner (Margaret McAuliffe): Case #22-24 – Area Variance: Applicant is requesting one area variance pursuant to §154-7 of the Patterson Town Code in order to legalize a 29 ft. x 25 ft. storage shed. Town Code §154-7 requires accessory structures in the R-4 Zoning District to meet a minimum rear yard setback of 25 ft. Shed exists 18.2 ft. ± from the rear property line; variance requested is for 7 ft. This property is located at 324 Fair Street. Tax Map 44.-3-4 (R-4 Zoning District).
5. Stephanie Walker & Roger Chappelle: Case #01-25 – Accessory Apartment: Applicant is requesting a special use permit pursuant to §154-105 of the Patterson Town Code in order to continue the previously granted use of an accessory apartment within a single-family dwelling. This property is located at 128 Apple Hill Road. Tax Map 35.-4-124 (R-4 Zoning District).
6. Edward Napierkowski & Audrey Murjahn: Case #02-25– Area Variance: Applicant is requesting one area variance pursuant to §154-7 of the Patterson Town Code in order to construct a 12 ft. x 24 ft. shed with garage door. Town Code §154-7 requires accessory structures in the R-4 Zoning District to meet a minimum rear yard setback of 25 ft. Proposed shed will be 4 ft. from the rear property line; variance requested is for 21 ft. This property is located at 791 Route 311. Tax Map 13.-3-58 (R-4 Zoning District).
